We have a huge non permitted deck in the back that is not attached to house and some appliances that are still fairly new that we installed can we legally take those items?

Anything “permanently attached” to the property is part of the real estate. Built-in appliances, like most dishwashers, are part of the real estate. A free-standing refrigerator or range is considered personal property, just like your clothes and shampoo. If your deck is attached to the real estate (house OR land) it is considered part of the real estate. In other words, your HOUSE didn’t sell at auction last week, your REAL ESTATE sold at auction last week; your house AND lot, including everything permanently attached to it.
I would say anything and everything that was at the house and land at the time of showing and bidding needs to stay. If you take something out then you are taking chances of having problems. leave it all behind. Buy new stuff at the new place you get later. Everything es replaceable anyway. Avoid a hassle.
You can not take the deck. You can take your appliances if they are not built in and in most cases the only appliance built in would be a dishwasher.
